Neuro-psychological exam requested for one of Cassie Jo Stoddart's killers

Exam Requested By Adamcik’s Private Counsel in Pocatello:

I’ve posted about the murder of Cassie Jo Stoddart before. She was the 16-year-old Idaho girl who was brutally killed by two scumbags she thought were her friends, Brian Draper and Torey Adamcik. They also videotaped her murder. Back in August they were both sentenced to life without parole after they were tried as adults.

Now the attorney for Adamcik is requesting that his client receive a neuro-psychological exam for his client on the taxpayer’s dime to see if he has a brain deficiency.

Brain deficiency? Adamcik and Draper sliced Cassie Jo Stoddart to ribbons, videotaped it, and bragged about her murder on the tape. He doesn’t have a brain deficiency he has a soul deficiency and a humanity deficiency and hopefully a judge will make sure he has a society deficiency for the rest of his life.

Judge Allows Brain Exam on Adamcik:

Congratulations to the citizens of Idaho. You’re now footing the bill for a neurological exam for an already convicted killer.

Torey Adamcik and his mutant buddy Brian Draper were both sentenced to life without parole in the brutal murder of 16-year-old Cassie Jo Stoddart. Don’t forget they also videotaped the murder.

Now Judge Peter McDermott has allowed the request of Adamcik’s attorney for the state to pay for a brain scan because his lawyer claims that Adamcik has a ‘brain deficiency’.

In his ruling Judge McDumbass stated…

“Mr. Adamcik is a needy person… He is being detained under a conviction of a serious crime, since he has been sentenced to a fixed life term without the possibility of parole. Mr. Adamcik does not have the funds, or the ability to generate the funds necessary to conduct the neuropsychological examination requested by his attorney.”

So how is that the state’s responsibility? The state has already proved Adamcik’s role in Cassie Jo Stoddart’s murder. Why should state now have to foot the bill for a ploy by his attorney to get his sentence reduced. If McDermott wants the test done so bad why doesn’t he pay for it out of his own pocket. Better yet why don’t all the people who think that he shouldn’t have been tried as an adult chip in. Oh that’s right, they don’t put their money where their mouth is.

Pocatello Teen Denied Reduced Life Sentence:

17-year-old Torey Adamcik is one of the teens convicted in the brutal murder of 16-year-old Cassie Jo Stoddart. Along with his mutant buddy Brian Draper, the pair was sentenced to life without parole. Adamcik’s attorney requested a reduced sentence. Let’s hear from the attorney in question, Aaron Thompson…

“He is just a boy. A 17-year-old boy. A boy with absolutely no hope. A boy with absolutely no future,” said Aaron Thompson, Torey Adamcik’s Attorney.

He’s got a hell of a lot more future than Cassie Jo Stoddart has.

“So what if Torey is in a tiny little room? My granddaughter will never leave her casket,” said Paul Cisneros, Cassie Jo Stoddart’s grandfather.

Anyway, the request for reduced sentencing was denied and the judge laid the ol’ legal smackdown…

“He is guilty. He was found guilty. And he’s guilty as conduct. They jury has spoken. I don’t believe Mr. Adamcik should ever be released from prison. I’m going to deny your motion,” said Judge Peter McDermott, Bannock County.

It’s so refreshing to see a judge tell it like it is.

Adamcik’s cohort Draper will be in court on a similar request in 2 weeks. I’d be surprised if the scenario didn’t repeat itself.

Convicted Teen Killer Tried to Have Sentence Reduced:

When Torey Adamcik had his reduced sentence request denied in the murder of Cassie Jo Stoddart I knew his cohort would have his request denied too.

Brian Draper tried to get his life without parole sentence changed to where he would be eligible for parole in 25 years. That request was denied with extreme prejudice…

In the end, Judge McDermott said Brian Draper can live – Cassie can’t. He went on to say she had the worst punishment compared to the teens.

Bravo. Justice for once.

Mr. A shot me an e-mail the other day saying that he found the MySpace of Brian Draper. For those of you who don’t know Brian Draper and his cohort Torey Adamcik were two teens sentenced to life in prison for the brutal murder of 16-year-old Cassie Jo Stoddart.

Draper is not only a vicious killer but he’s also an admitted mutant, the term I use for ‘fans’ of Columbine.

I figured that the MySpace was probably a leftover before he went into prison and probably contained the incoherent ramblings of a teenage monster. Imagine my surprise when this is what I stumble on.

Many things have happened since the last time I updated this page: I have moved to the prison in Boise, Idaho, and I am in a transition stage that may last a couple weeks. Following the transition I will be moved to a new location in Boise.

I want you all to know that I am hanging in there. Things get rough from time to time, and I don’t go a week without breaking down at least once. But overall my life is ok. I keep busy by going to religious services, attending educational classes (creative writing, computers), writing, reading and playing a lot of chess. I am also able to play the piano down at the chapel. I play piano for church services, and for an hour a week I can play the piano in solitude. I wrote a song dedicated to everything that has happened, called Sorrows and Sunrises.

Obviously this wasn’t written by Draper for a number of reasons. The first being I don’t think Draper could form a coherent sentenced if you spotted him the noun and the verb. Secondly, most prisons don’t allow their inmates to have access to the internet. Lastly, Draper and Adamcik have kind of become the poster boys for the people who believe that teens shouldn’t be charged as adults. For example…

Currently I am in the appeals process, so that maybe someday I can be released and start redeeming myself on the outside, like I am doing now, on the inside. I am in the STOP program here, which is a program that brings kids into the facility, and inmates speak with them about being a good person and staying out of trouble. I am one of those inmates that speak to the kids.

If my appeal for reduction of sentencing is thrown out, then I will be content with the life I have. We must think about what we do have, not about what we don’t have. We must set goals and strive to meet them. If I spend the rest of my life locked in a prison, I will rise above that. If God wants me to stay here, then this is where I will stay.

I will leave you with two good sayings: “I wept because I had no shoes till I saw a man who had no feet.” “Two men looked out through prison bars; one saw mud, the other stars.”

Thanks again for all your support, I hope and pray you are all doing well.

I love you all, and thank you for believing in me. Never forget Cassie Jo Stoddart.

Your friend,

Brian

Who I’d like to meet:

Hemingway, Albert Einstein, Richard Wilbur, and James P. Gills

First off he gave up any right of talking about Cassie Jo Stoddart, especially after he said this on videotape after her murder.

“Just killed Cassie, we just left her house, this is not a f***ing joke,” says Brian Draper on the homemade videotape. “I’m shaking,” replies Adamcik.”I stabbed her in the throat and I saw her lifeless body just disappear,” says Draper.

I highly doubt someone who did this is capable of all these ‘feel good’ statements and if he is going through all these programs I’m sure it’s all for show. I also noticed the lack of negative comments on his MySpace. Brutal killers usually get slammed with ‘see you in hell’ kind of comments which leads me to believe that not only was this crap written by someone else but it’s also being severely moderated.

Lastly I doubt the people he wants to meet or Hemingway and Einstein. It’s probably more like Manson, Dahmer, Harris and Klebold.

Someone who slashes a girls throat just for the thrills and brags about it on tape isn’t going to change his stripes this quickly let alone ever.

Brian Draper's MySpace revisited

Maintenance of Convicted Killer Brian Draper’s Myspace Page in Question:

Not too long ago I posted about the MySpace of convicted killer, lifer, and mutant Brian Draper. Draper is one of the teen killers convicted in the 2006 slashing death of someone whom they called friend, Cassie Jo Stoddart.

I theorized that his MySpace was obviously written by either a member of his family or an advocate who believes that teens should never be charged as adults. I came to that hypothesis after I noticed the proper grammar which I doubt Draper has and the fact that prison inmates usually don’t have access to the internet. It seems that one of my readers tipped off the local media to Draper’s MySpace.

We’ve previously reported on a website that supports Torey Adamcik’s innocence called Voices for Torey. Thanks to a viewer, we tracked down a commentary page that negatively outlines the possibility of Brian Draper updating his myspace page from prison.

Earlier this month, “A Murderer’s Disguise” was posted on the website called The Trenchcoat Chronicles. On it, Trench Reynolds debunks the idea that Draper can access the internet saying, among other things, that the two teenagers have become poster boys for people who believe teens should not be charged as adults. Reynolds simply states that someone else must be maintaining the personal page.

KPVI then followed up on my assumptions and called the Idaho Department of Corrections. They have confirmed that inmates do not have access to the internet. So is it being maintained by family or an advocate? Is Draper actually in the programs that he claims and is it just for show?

None of this could have been possible if it wasn’t for the watchful eye of Mr. A who brought my attention to Draper’s MySpace in the first place.

Brain Draper

I’ve posted about Brian Draper many times before. In 2006 Draper and his cohort Torey Adamcik stabbed Cassie Jo Stoddart of Pocatello, Idaho to death. At the time of her murder Draper and Adamcik made a video of the murder and bragged about killing Cassie Jo in the video. Here’s a sample…

“Just killed Cassie, we just left her house, this is not a f***ing joke,” says Brian Draper on the homemade videotape. “I’m shaking,” replies Adamcik.”I stabbed her in the throat and I saw her lifeless body just disappear,” says Draper.

Let’s not forget that Draper was also a Columbine worshiping mutant

This is a passage written by Draper that was shown in court today. Titled Columbine, it reads: “I am becoming more and more obsessed with Columbine. It seems now that that’s all I think about. I would give anything to go back in time, and be a part of Eric Harris and Dylan Klebold’s lives. They are my heroes. I will follow in their footsteps and maybe I’ll even meet them.”

Adamcik and Draper were both 16 at the time of Cassie Jo’s murder but were tried as adults and both were given life sentences.  They’ve both have had appeals for reduced sentences denied but now Draper is shooting for a new trial on the “Think of the Children” plan…

Sentencing Brian Draper — who was 16 at the time of the crime — to life in prison without the possibility of parole would be unconstitutionally cruel, state appellate public defender Molly Huskey told justices

Huskey argued a district court judge erred in sentencing Draper to the fixed life term. Huskey said her client’s immaturity and poor judgment were partially attributable to his youth at the time of the crime and that he deserved a chance for release. She also said the jury received erroneous instructions.

“Even if this court finds that a fixed life sentence can be imposed on a juvenile, that sentence cannot be imposed based solely on the egregiousness of the offense,” Huskey said.
If justices won’t vacate his conviction, she wants them to give him a life sentence that allows for his release after 30 years.

How come cruel and unusual only applies to the treatment of killers but not their victims? Was it not cruel and unusual for Cassie Jo Stoddart to be stabbed in the throat and then videotaped? This case has nothing to do with immaturity and poor judgement but has everything to do with two little mutant bastards just being plain evil. If you don’t know that stabbing someone in the throat is wrong by the time your 16 then you should be removed from society anyway. Also as I’ve said with many murders before Cassie Jo can’t be released from death after 30 years so why should Draper be released from prison?

The guilty should be punished not coddled.

Idaho Supreme Court upholds murder conviction of Pocatello teen in killing of classmate:

The last I posted about Brian Draper he was appealing to have a new trial in the murder of Cassie Jo Stoddart. In 2006 Draper and his cohort, Torey Adamcik stabbed their classmate to death in her Pocatello, Idaho home and then bragged about it on video tape afterwards. Draper and Adamcik were both 16 at the time of Cassie Jo’s murder. They were both charged as adults and both given life without parole. They’ve both become poster children for what I like to call the kid criminal crowd. They are people who believe that a juvenile should never be charged as an adult.

Draper is also an admitted mutant. That’s the term I use for people who either worship or empathize with the Columbine killers which is how this case came to my attention.

Anyway the Idaho Supreme Court thankfully upheld not only Draper’s conviction but his sentence as well. They did throw out his conspiracy conviction due to faulty instructions given the jury but as long as he’s still behind bars for life I can live with that.

Draper’s attorney used the ‘immaturity and poor judgement’ argument to try to get her client a new trail but it didn’t fly. As I’ve said many times before if by the age of 16 you don’t know that murder is wrong then you have no business being in society in the first place.

Adamcik is also appealing his conviction but so far has met with the same failure and hopefully he will again.

Idaho Supreme Court upholds conviction and sentence of Torey Adamcik:

Much like his mutant cohort Brian Draper, Torey Adamcik had his conviction upheld by the Idaho Supreme Court. Adamcik and Draper were convicted and sentenced to life for the brutal 2006 stabbing murder of their ‘friend’, 16-year-old Cassie Jo Stoddart.

As I’ve mentioned before Draper and Adamcik have been held up by the kid criminal crowd as poster children that kids should not be charged as adults. They were both 16 at the time of Cassie Jo’s murder but you tell me if these are kids that are deserving of any mercy. The pair actually bragged about the murder on videotape. From my first post on the murder

“Just killed Cassie, we just left her house, this is not a f***ing joke,” says Brian Draper on the homemade videotape. “I’m shaking,” replies Adamcik.”I stabbed her in the throat and I saw her lifeless body just disappear,” says Draper.

Cassie Jo’s family can’t argue if she should be dead as an adult or dead as a child. She’s just dead. Brutally killed by people she thought were her friends.

Cassie Jo Stoddart

In 2006 16-year-olds Torey Adamcik and Brian Draper brutally stabbed and killed their friend, 16-year-old Cassie Jo Stoddart of Pocatello, Idaho. They even recorded portions of their crime. Again from my first post on Cassie Jo’s murder

“Just killed Cassie, we just left her house, this is not a f***ing joke,” says Brian Draper on the homemade videotape. “I’m shaking,” replies Adamcik.”I stabbed her in the throat and I saw her lifeless body just disappear,” says Draper.

Both were tried as adults, both were convicted and both were sentenced to life in prison. Another thing they have in common is that they both have sought to receive new trials and so far both of their convictions have been upheld. Now, once again, Adamcik is trying again for a new trial and the reasoning behind it astounds me in its equal parts cruelty and stupidity.

“The theory of the case is that Torey didn’t inflict the fatal wound and due to missteps by the defense, critical evidence that would have supported that theory of the case was excluded,” said Dennis Benjamin, Adamcik’s attorney.

Torey Adamcik

Torey Adamcik

Cassie Jo was stabbed 29 times. So Adamcik’s lawyer is actually arguing that out of the 29 times that she was stabbed his client didn’t administer the stab that killed her. So what were they then, paper cuts, flesh wounds? This is the ultimate insult to not only Cassie Jo’s memory but to her family as well.

Hopefully the courts will see this for the idiocy it is and keep this murdering coward behind bars for the rest of his unnatural life.

No accountability in Accountability Act

Pocatello Attorney Talks About Juveniles Serving Life Sentences:

Some waste if a suit in Washington, I mean a congressman from Virginia, is trying to get a law passed that would stop juveniles from being sentenced to life without parole.

Congressman Robert Scott has introduced the Juvenile Justice Accountability and Improvement Act of 2007, otherwise known as H.R. 4300.

Congressman Robert Scott: “Giving someone life without parole means they can’t even be considered for parole.”

Thanks for that update Obvious Man.

The article then brings up Torey Adamcik and Brian Draper, two teens sentenced to life without parole for the brutal videotaped murder of Cassie Jo Stoddart.

Adamcik’s attorney thinks this is the greatest thing since ambulances were invented…

Aaron Thompson: “Cooperation and volunteering for all the programs that are available in prison where you can rehabilitate and work towards something where life means something on a day-to-day basis, knowing that there is a light at the end of the tunnel.”

Do you mean like the light at the end of the tunnel that Cassie Jo has to look forward too? Oh no, wait, there is no light for her because you’re client killed her.

Some people say that life without parole for Adamcik is vengeance and not justice. So what? It’s not real vengeance since Adamcik is still allowed to draw breath.

The article states that there are 2500 juveniles serving life without parole in the U.S. I wish that number was bigger. Not to mention that how many of those 2500 are gang members and how many are kids like Adamcik. I bet the number of gang members is extremely disproportional to the other teen murderers.

And speaking of gangs I guess Congressman Scott is doomed to repeat history. The reason the life without parole for juveniles came about, in my opinion, because of the gang killings of the late 80’s and early 90’s. If HR 4300 were to pass it would just be letting these dangerous felons back out on the streets but I guess he’s ok with that.

It should be justice for the victims not rainbows and sunshine for the killers.

Late last week a judge denied Torey Adamcik’s request for either a new trial or a reconsidered sentence. Adamcik’s attorney argues that recent court rulings that say mandatory life sentences for teens are cruel and unusual however the judge disagreed that those rulings applied in the case of Adamcik.

Along with cohort Brian Draper, Adamcik was tried as an adult, convicted and sentenced to life for the 2006 murder of 16-year-old Cassie Jo Stoddart. The pair had bragged about the murder on videotape after stabbing Cassie 29 times. Draper was also a fan of the Columbine shooters, what I call a mutant and what Tumblr users call a columbiner.

Idaho Supreme Court upholds sentence of one of Cassie Jo Stoddart's killers

This happened a few weeks ago, but you should be used to that by now with me. Sorry, just getting to it now.

Anyway, in late December, the Idaho Supreme Court upheld the life sentence of Torey Adamcik. Adamcik and Brian Draper were juveniles when they killed their friend, 16-year-old Cassie Jo Stoddart, in September of 2006. The pair were charged as adults and both were convicted and sentenced to life for the brutal murder of Cassie. Since their 2007 convictions, both men have filed many appeals claiming that sentencing juveniles to life is unconstitutional or they didn’t have effective counsel. All previous efforts to escape their convictions have failed.

There are some who believe that the pair were too young to be sentenced to life in prison. It’s my opinion that they were plenty old enough to know what they were doing was wrong considering they killed Cassie just for the thrill. The pair also videotaped themselves before and after Cassie’s murder talking about how they were going to kill her. The transcripts from the tapes have been released.

Before the murder, Adamcik told Draper, “we’re not going to get caught,” to which Draper replied by saying, “we’re going to make history,” according to the transcript in the Supreme Court’s opinion.

The transcript includes conversation between Adamcik and Draper referencing horror-slasher films like “Scream” and comparing themselves to serial killers like Ted Bundy, the Hillside Strangler and the Zodiac Killer.

“Those people were mere amateurs compared to what we are going to be,” Adamcik said.

In another segment of the transcript, Draper says “I feel like I want to kill somebody. Uh, I know that’s not normal, but what the hell.”

Adamcik replied, “I feel we need to break away from normal life.”

According to the transcript, Draper said he and Adamcik identified Stoddart as their victim the day before the murder, despite claiming she was their friend.

“We’ll find out if she has friends over, if she’s going to be alone in a big dark house out in the middle of nowhere. How perfect can you get?” Draper said.

“I’m horny just thinking about it,” Adamcik replied.

These are not two people, and I use that term loosely, who should be released back into society. Not only did they know what they were doing but they documented their actions as well, like it was a home movie to be rewatched later. They are the definition of depraved and probably have no remorse for Cassie’s senseless murder.

Torey Adamcik's life sentence upheld for 2006 murder of Cassie Jo Stoddart

Torey Adamcik

I guess it’s time for our annual post about how Torey Adamcik has had his life sentence upheld by the Idaho Supreme Court again. For those of you who may be unfamiliar with the story, in 2006, 16-year-olds Brian Draper and Torey Adamcik brutally murdered their friend Cassie Jo Stoddart of Pocatello, Idaho. They stabbed her to death and bragged about it on video.

At the time of their sentencing in 2007, there was a groundswell of support not to sentence them to life. They had conviction been tried, convicted, and sentenced as adults. In what seems like every year since his conviction, the now 29-year-old Adamcik has tried to have his life sentence without parole repealed with his defense claiming that he was too young at the time to understand his actions.

The videotape says otherwise.
